Welcome to Premier Home Pros. This website and related online services are owned and operated by Premier Home Pros, LLC and its subsidiaries and affiliates (collectively, “Premier Home Pros,” “Premier,” “we,” “our,” or “us”).

These Terms of Use (“Terms”) govern your access to and use of our websites, forms, landing pages, digital advertising, text messaging programs, and all related online services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

Important: These Terms contain a binding arbitration provision and a waiver of class actions and jury trials. See “Dispute Resolution and Arbitration.”

1. Scope

These Terms apply only to your use of our online and digital Services.
They do not govern any remodeling project, installation, purchase, or other transaction with Premier Home Pros.

All customer projects, including pricing, materials, installation, warranties, and service terms, are governed exclusively by your signed customer contract.

2. Changes to the Services and These Terms

We may modify these Terms or the Services at any time without prior notice. Changes are effective upon posting. Your continued use of the Services after changes are posted constitutes your acceptance of those changes.

3. Eligibility and Access

The Services are intended for residents of the United States. You may not use the Services if you are under 18 years old, located outside the U.S., or otherwise prohibited by law.

We reserve the right to restrict or terminate access to the Services for any user at any time for any reason.

4. Privacy

Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and protect your information. By using the Services, you consent to our data practices as described there.

5. Personal and Lawful Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not:

• Use the Services in a manner that could damage or disable our systems or networks.
• Attempt to gain unauthorized access to any systems, accounts, or data.
• Copy, reproduce, sell, or resell any portion of the Services or their content.
• Upload or transmit any virus, malware, or harmful code.

All trademarks, logos, and brand names displayed on the Services are the property of Premier Home Pros or their respective owners.

7. Reviews, Photos, and Submissions

If you submit a review, testimonial, photo, or message to us (“User Content”), you grant Premier Home Pros a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, display, and publish that content in marketing, advertising, or online promotion.

By submitting User Content, you represent that you own or have permission to share it and that it does not infringe any third-party rights.

8. Text Messaging and Communications

If you opt in to receive text messages from Premier Home Pros, you consent to receive recurring messages about appointments, reminders, promotions, and updates.

• Message frequency: up to 25 messages per month
• Reply “STOP” to unsubscribe; “HELP” for assistance
• Message and data rates may apply
• Participation is not required to make a purchase or receive services
• Carriers are not responsible for delayed or undelivered messages

9. Linked Websites

The Services may contain links to third-party websites. These links are provided for convenience only. We do not control or endorse third-party sites and are not responsible for their content, security, or privacy practices.

You use third-party websites at your own risk.

10. Disclaimer of Warranties

The Services are provided “as is” and “as available,” without any warranty or representation of any kind, express or implied.

We make no warranties that:

• The Services will be secure, uninterrupted, or error-free;
• Information provided through the Services is current or accurate; or
• Any content or functionality will meet your expectations or requirements.

To the maximum extent permitted by law, all implied warranties—including merchantability, fitness for a particular purpose, and non-infringement—are disclaimed.

11. Limitation of Liability

In no event shall Premier Home Pros, its affiliates, or its contractors be liable for any indirect, consequential, incidental, or punitive damages (including loss of profits or use) arising out of or related to our Services.

Our total liability shall not exceed the total amount paid by the customer for the specific project giving rise to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Premier Home Pros and its affiliates, officers, employees, and contractors from and against any claims, liabilities, or expenses (including attorney’s fees) arising out of your use of the Services or violation of these Terms.

13. Dispute Resolution and Arbitration

Agreement to Arbitrate:
You and Premier Home Pros agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration under the Federal Arbitration Act and administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules (www.adr.org/rules).

Class Action Waiver:
You and Premier Home Pros agree to resolve disputes only in your individual capacity—not as a plaintiff or class member in any purported class or representative proceeding.

Small Claims and Injunctive Relief:
Either party may bring an individual action in small claims court or seek injunctive relief to protect intellectual property or confidential information.

Venue and Governing Law:
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. If arbitration is deemed unenforceable, exclusive jurisdiction lies in state or federal courts in Summit County, Ohio.

15. Severability and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect. No waiver of any term is a waiver of any other term.

These Terms, together with our Privacy Policy and Accessibility Statement, form the entire agreement governing your use of the Services.
